Washware Essentials is primarily a business to business trade website but we understand consumers may wish to occasionally purchase goods from us. In those instances we would appreciate it if you could contact us to discuss your requirements before ordering to make sure you are purchasing the correct products.

In the event a consumer wishes to return a product your rights are listed below - separate terms for business users are listed below the consumer terms.

Consumer right of return and refund

This clause only applies if you are a consumer.

If you are a consumer, you have a legal right to cancel a contract during the period set out below. This means that during the relevant period if you change your mind or for any other reason you decide you do not want to keep a product, you can notify us of your decision to cancel the contract and receive a refund minus a restocking charge to cover administration, checking of the product and repackaging. Advice about your legal right to cancel the contract is available from your local Citizens' Advice Bureau or Trading Standards office.

However, this cancellation right does not apply in the case of:

  • any made-to-measure or custom-made products or products made to your specification or clearly personalised;
  • any modified products to your specification such as stainless-steel toilets with seat holes or wash troughs with tap holes;
  • any vitreous china ware;

Right to cancel

You have the right to cancel this contract within 14 days without giving any reason.

The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods or the last good or the last lot or piece (as the case may be).

To exercise the right to cancel, you must inform us of your decision to cancel this contract by a clear statement (e.g. a letter sent by post Washware Essentials Ltd, Kestrel Court, Harbour Road, Bristol, North Somerset, BS20 7AN or e-mail to sales@washwareessentials.co.uk).

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

Effects of cancellation

If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).

We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.

We will make the reimbursement without undue delay, and not later than-

(a) 14 days after the day we receive back from you any goods supplied, or
(b) (if earlier) 14 days after the day you provide evidence that you have returned the goods, or
(c) if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

If the consumer has received goods in connection with the contract you shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Your right of cancellation – FOR BUSINESSES (B2B) ONLY

If you are not a consumer, then you have no right of cancellation, refund or return once we have accepted your offer to buy the goods or service, unless, under the law of contract, you have a legal right to cancel and you are cancelling it for that expressed reason.

Despite the letter of the law we understand that there are instances where business customers may wish to return or exchange products that have been purchased.

For standard stock items we have a strict 30 day returns policy subject to approval and a 25% re-stocking charge. All goods would need to be approved for return and returned at the purchasers expense by the same method of transport as delivered (carrier / pallet etc). Goods would need to be in "as sold" condition with all components and original packaging. Once approved for return there is a strict 14 day return period to return the items.
